Subject: Transfer of Administrative Jurisdiction of Navassa Island to the United States Fish and Wildlife Service
Sec. 1 Purpose. On April 22, 1999, Navassa Island National Wildlife Refuge (Refuge) was established by a Memorandum of Understanding (MOU) between the Director of the United States Fish and Wildlife Service (Service), Department of the Interior (Interior), and the Director of the Office of Insular Affairs, Interior. The Refuge was established as an overlay refuge consisting of Navassa Island and its surrounding submerged lands and waters out to the twelve (12) nautical mile Territorial Sea Boundary. The purpose of this Order is to delegate the authority of the Secretary over Navassa Island to the Director of the Service. This action is taken to further protect the unique ecosystem of Navassa Island and the adjacent coral reefs and marine waters.
Sec. 2 Authority. The authority for this Order is derived from: 1) the National Wildlife Refuge System Administration Act of 1966, as amended, 16 U.S.C. §§ 668dd, et seq.; 2) 43 U.S.C. § 1458; 3) Reorganization Plan No. 3 of 1950; 4) the Fish and Wildlife Act of 1956, 16 U.S.C. § 742f; and 5) Executive Order 13089, dated June 11, 1998.
Sec. 3 Delegation and Administration. All of the authority of the Secretary for the civil administration of Navassa Island is hereby delegated to the Director of the Service. This delegation supersedes the delegation for the administration of Navassa Island to the Director, Office of Insular Affairs, set out in Order No. 3205, dated January 16, 1997, as amended by Amendment No. 1 dated January 14, 1998. Order No. 3205, as amended, is hereby revoked. The Service, which has been managing the Refuge pursuant to the MOU, will continue to manage the Refuge under all applicable laws, policies and regulations that govern the National Wildlife Refuge System. In carrying out those responsibilities, and consistent with those authorities, the Service shall insure that the unique ecosystem of the Refuge is managed to preserve its natural character in support of the protection and conservation of the fish and wildlife in the Refuge.
Sec. 4 Effective Date. This Order is effective immediately.
