Subject: Administration of Navassa Island

Sec. 1 Purpose. In furtherance of United States sovereignty over Navassa Island, the purpose of this Order is to delegate the Secretary's responsibilities for the administration of Navassa Island to the Director of the Office of Insular Affairs and to establish the process for entry onto Navassa.

Sec. 2 Authority. The authority for this Order is derived from 43 U.S.C. §1458 and Reorganization Plan No. 3 of 1950.

Sec. 3 Delegation. All of the authority of the Secretary of the Interior for the civil administration of Navassa Island, including the executive and judicial functions, is hereby delegated through the Assistant Secretary - Policy, Management and Budget to the Director of the Office of Insular Affairs. This authority may be redelegated.

Sec. 4 Entry onto Navassa Island. Except for otherwise authorized officers or employees of the United States, all individuals wishing to enter onto Navassa Island or into its surrounding waters, shall first obtain written permission from the Director of the Office of Insular Affairs. The Director shall establish a process for obtaining such permission. The process so established shall include a provision that individuals with permission must have said permission in their possession at all times while in or around Navassa. The Director shall take steps to assure that United States law enforcement officers are aware of the need for permission prior to entry onto Navassa and to assure that they may confiscate any property taken from Navassa or its surrounding waters. He shall further assure that enforcement of this prohibition on trespass on Navassa will include all appropriate measures, including criminal prosecution.

Sec. 5 Effective Date. This Order is effective immediately. It will remain in effect until its provisions are converted to the Departmental Manual or until it is amended, superseded or revoked, whichever occurs first. The Office of Insular Affairs will provide an amendment or Departmental Manual chapter to the Assistant Secretary - Policy, Management and Budget by one year from the date of signature of this Order.
